Account means a unique record created for the End User, Tutor Service Provider, and/or Babysitter Service Provider to access the TeachSitter Neutral Services Marketplace Platform.
Agreement is the approval and acceptance of using the TeachSitter Neutral Services Marketplace Platform provided by TeachSitter LLC.
Babysitter Service Provider(s) means you are at least of the legally required age in the jurisdiction in which you reside (18 years of age) and are otherwise capable of entering into binding contracts and are seeking to perform short term babysitting services for the End User in the TeachSitter Neutral Services Marketplace Platform.
Background Check (s) means a review process that is conducted before the Tutor Service Provider and/or Babysitter Service Provider can be a provider of short-term tutoring and/or babysitting on the TeachSitter Neutral Services Marketplace Platform and may include but is not limited to: Identity verification, right to work checks, and criminal background checks, using third party services as appropriate.
Company (referred to as either "TeachSitter", "We", "Us" or "Our" in this Agreement) refers to TEACHSITTER LLC, 3419 Westminster Ave. Suite 358-G Dallas, TX 75205.
Content is defined as any information and materials you provide to TeachSitter, its Third Party Service Providers, or other Users in connection with your registration for and use of the TeachSitter Neutral Services Marketplace Platform and participation in TeachSitter promotional campaigns, including without limitation the information and materials posted or transmitted for use and refers to items on the website such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by the End User, Tutor Service Provider, or Babysitter Service Provider, regardless of the form of that content.
Cookies are small files that are placed on Your computer, mobile device, or any other device by a website, containing the details of Your browsing history on that website among its many uses.
Country refers to: United States
Device means any instrument that can access the TeachSitter Neutral Services Marketplace Platform such as a computer, a smartphone or a digital tablet.
End User(s) means you are at least of the legally required age in the jurisdiction in which you reside (18 years of age or older) and are otherwise capable of entering into binding contracts and refers to the use of the TeachSitter Neutral Services Marketplace Platform for short-term tutoring and babysitting assistance.
Personal Data is any information that relates to an identified or identifiable individual.
PSP means a Payment Service Provider that facilitates the payment within the TeachSitter Neutral Services Marketplace Platform and between End Users, Tutor Service Providers, and/or Babysitter Service Providers which all are bound by the PSP Services Agreement with the Terms of Service by the PSP.
Service(s) refers to the online network of End Users needing short term tutoring or babysitting services from Tutor Service Providers and/or Babysitter Service Providers providing short term tutoring and babysitting assistance on the TeachSitter Neutral Services Marketplace Platform.
TeachSitter Neutral Services Marketplace Platform means the desktop website and/or mobile website provided by TeachSitter used by the End User, Tutor Service Provider, and Babysitter Service Provider on any electronic device for tutoring and babysitting services.
Third Party Service Providers means any services or content (including data, information, products, or services) provided by a third-party that may be displayed, included, or made available on the TeachSitter Neutral Services Marketplace Platform.
Third Party Social Media Service means any services or content (including data, information, products, or services) provided by a third-party that may be displayed, included, or made available.
Tutor Service Provider(s) means you are at least of the legally required age in the jurisdiction in which you reside (18 years of age) and are otherwise capable of entering into binding contracts and are seeking to perform short term tutoring services for the End User in the TeachSitter Neutral Services Marketplace Platform.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
Website refers to TeachSitter, accessible from https://www.teachsitter.com
You refers to an individual connecting by a digital device to the TeachSitter Neutral Services Marketplace Platform as an End User, Tutor Service Provider, and/or Babysitter Service Provider.

ACKNOWLEDGEMENT AND ACCEPTANCE OF THESE TERMS

This is the Privacy Policy governing the use of the TeachSitter Neutral Services Marketplace Platform and the Agreement that operates between You and TeachSitter LLC. This Privacy Policy sets out the rights and obligations of all Users regarding the use of the TeachSitter Neutral Services Marketplace Platform.

COLLECTING AND USING YOUR PERSONAL DATA AND TYPES OF DATA COLLECTED

PERSONAL DATA

While using the TeachSitter Neutral Services Marketplace Platform, TeachSitter or its Third-Party Service Providers may ask End Users, Tutor Service Providers and/or Babysitter Service Providers to provide certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to, email address, first and last name, phone number, address, city, state, zip/postal code.

Tutor Service Providers and/or Babysitter Service Providers are required to pass a background check that is administered by a nationally recognized Third-Party Service Provider. The sensitive information like your Social Security Number that you provide is only reviewed by the Third-Party Service Provider. Tutor Service Providers and/or Babysitter Service Providers will be required to speak with a Third-Party Service Provider background check representative to verify information that is supplied for verification purposes for the safety of all who use the TeachSitter Neutral Services Marketplace Platform. The background check report will verify instant state and county clerk information, Federal watch lists, national sex offender registry, national most wanted, FCRA and state filters, and other background check information of the applicant.

USAGE DATA

Usage Data is collected automatically when using the TeachSitter Neutral Services Marketplace Platform.

Usage Data may include information such as Your Device's Internet Protocol address, browser type, browser version, the pages of the TeachSitter Neutral Services Marketplace Platform that are visited, the time and date of the visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

When the TeachSitter Neutral Services Marketplace Platform is accessed by or through a Device, TeachSitter may collect certain information automatically, including, but not limited to, the type of mobile device You use, mobile device unique ID, the IP address of the mobile device, the mobile operating system, the type of mobile Internet browser used, unique device identifiers, and other diagnostic data.

As an End User, Tutor Service Provider and/or Babysitter Service Provider, you may also have the option of sharing additional information with TeachSitter through the Third-Party Social Media Service's account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving TeachSitter permission to use, share, and store it in a manner consistent with this Privacy Policy.

INFORMATION COLLECTED WHILE USING THE APPLICATION

By accessing or using the TeachSitter Neutral Services Marketplace Platform, in order to provide certain features of the TeachSitter Neutral Services Marketplace Platform, TeachSitter may collect, with your prior permission, information regarding your location and Content. Location information is to provide features of the TeachSitter Neutral Services Marketplace Platform and to improve and customize the TeachSitter Neutral Services Marketplace Platform experience. Additionally, Content is collected for promotional campaigns and/or marketing material. The information may be uploaded to TeachSitter's servers, on a Third-Party Service Provider's server, or it may be stored on Your device.

Access Your End User Profile, Tutoring Service Provider Profile, and/ or Babysitter Service Provider Profile within the TeachSitter Neutral Services Marketplace and delete the location information, delete content, or delete your End User Profile, Tutor Service Provider Profile and/or Babysitter Service Provider Profile. End Users, Tutoring Service Providers, and/ or Babysitter Service Providers can also enable or disable location services through the TeachSitter Neutral Services Marketplace Platform at any time, through Your Device on the TeachSitter Website.

TRACKING TECHNOLOGIES AND COOKIES

All End Users, Tutor Service Providers, and Babysitter Service Providers represent and warrant that the TeachSitter Neutral Services Marketplace Platform uses Cookies and similar tracking technologies to track activity on the TeachSitter Neutral Services Marketplace Platform and store certain information pertaining to your Account. These Tracking technologies may include, but are not limited to, beacons, tags, and scripts to collect and track information and to improve and analyze The TeachSitter Neutral Services Marketplace Platform.

You can instruct Your browser on your Device to refuse all Cookies or to indicate when a Cookie is being sent. To contact End Users, Tutor Service Providers and/or Babysitter Service Providers by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including the security updates, when necessary or reasonable for their implementation.
To provide End Users, Tutor Service Providers and/or Babysitter Service Providers with news, special offers and general information about other goods, services, and events which TeachSitter offers that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
To attend and manage End Users, Tutor Service Providers and/or Babysitter Service Providers requests to TeachSitter.

All End Users, Tutor Service Providers and/or Babysitter Service Providers represent and warrant that TeachSitter may share Personal Data

TeachSitter may share Your Personal Data with Third Party Service Providers to monitor and analyze the use of the TeachSitter Neutral Services Marketplace Platform, to show advertisements, to help support and maintain the TeachSitter Neutral Services Marketplace Platform, to contact You, to advertise on third party websites to You after You have visited the the TeachSitter Neutral Services Marketplace Platform, or for payment processing.
TeachSitter may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.
TeachSitter may share Your Personal Data with TeachSitter business partners to offer You certain products, services or promotions.

TeachSitter will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. TeachSitter will retain and use Your Personal Data to the extent necessary to comply with legal obligations, such as, if TeachSitter is required to retain your data to comply with applicable laws, resolve disputes, and enforce TeachSitter’s legal agreements and policies.

TeachSitter will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of the TeachSitter Neutral Services Marketplace Platform, or TeachSitter is legally obligated to retain this data for longer time periods.

By registering as an End User, Tutor Service Provider and/or Babysitter Service Provider, you recognize that information and Personal Data, is processed at TeachSitter's operating offices, Third Party Service Provider locations, and in any other place where the parties involved in the processing are located. It means that this information may be transferred to and maintained on computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of Your jurisdiction.

By registering as an End User, Tutor Service Provider and/or Babysitter Service Provider, You consent to this Privacy Policy followed by Your submission of such information and represent Your agreement to that transfer.

TeachSitter will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to a third party, organization, or a country unless there are adequate controls in place including the security of Your data and other personal information.

Disclosure of Your Personal Data In Business Transactions

If TeachSitter is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Under certain circumstances, TeachSitter may be required to disclose End User, TeachSitter Service Provider, and/or Babysitter Service Provider Personal Data if required to do so by law or in response to valid requests by public authorities such as a court or a government agency.

Detailed Information on the Processing of Your Personal Data

Third Party Service Providers have access to End User, TeachSitter Service Provider, and/or Babysitter Service Provider Personal Data only to perform their tasks on TeachSitter’s behalf and are strictly obligated not to disclose or use any User Personal Data for any other purpose.

CHILDREN’S PRIVACY

As an End User, you are at least of the legally required age in the jurisdiction in which you reside (18 years of age or older) and are otherwise capable of entering into binding contracts.

The TeachSitter Neutral Services Marketplace does not address anyone under the age of 18 without parental a legal guardian’s consent. Parental or guardian consent means that as an End User You are accessing and using the TeachSitter Neutral Marketplace Services Platform on behalf of another User/Child/Minor and that you represent that you have the authority to act on their behalf and to bind that person as the principal to all provisions of the Privacy Policy. We do not knowingly collect personally identifiable information from anyone under the age of 18. If an End User, Tutor Service Provider and/or Babysitter Service Provider, parent, or guardian are aware that Your child has provided TeachSitter with Personal Data, please contact TeachSitter immediately. If TeachSitter becomes aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, TeachSitter will take steps to remove that information from the TeachSitter servers. TeachSitter also may limit how information is collected, used, and stored for End Users below the age of 18. In some cases, this means Teachsitter will be unable to provide certain functionality of the TeachSitter Neutral Services Marketplace Platform to these users.

If TeachSitter needs to rely on consent as a legal basis for processing Your information and Your state or jurisdiction requires consent from an End User, then TeachSitter may require End User consent before TeachSitter collects and uses that information.

ANALYTICS

TeachSitter may use Third Party Service providers to monitor and analyze the use of the TeachSitter Neutral Services Marketplace Platform. TeachSitter may use web analytics services that track and report website traffic. TeachSitter and our Third-Party Service Providers use the data collected to track and monitor the use of the TeachSitter Neutral Services Marketplace Platform. The data collected could be shared with other services and may be used to contextualize and personalize ads for marketing purposes.

EMAIL MARKETING

We may use Your Personal Data to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. You may opt-out of receiving any, or all, of these communications from TeachSitter by following the unsubscribe link in the listing preferences of Your Profile on the TeachSitter website. TeachSitter may use Third Party Service Provider email marketing to manage and send emails to You.

PAYMENTS

TeachSitter may provide paid products and/or services within the TeachSitter Neutral Services Marketplace. To facilitate payment within the TeachSitter Neutral Services Marketplace, End Users, Tutor Service Providers, and/or Babysitter Service Providers must provide financial information to the PSP. Your financial information is provided directly to the PSP whose use of Your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

LINKS TO OTHER WEBSITES

The TeachSitter Neutral Services Marketplace Platform may contain links to other websites that are not operated by TeachSitter. As an End User, Tutor Provider and/or Babysitter Sitter Service Provider when You click on a Third-Party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit. TeachSitter has no control over and assumes no responsibility for the content, privacy policies or practices of any Third-Party websites or services.

CUSTOMER TEXTING AND MOBILE NUMBER

The TeachSitter Neutral Services Marketplace Platform does not sell your mobile number for advertising. It is only used for information and communication purposes during the signup process.

CHANGES TO THIS PRIVACY POLICY

TeachSitter reserves the right, at our sole discretion, to modify or replace this Privacy Policy at any time. If a revision is material TeachSitter will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at TeachSitters sole discretion.
